Iconic St. Elmo Steak House sued in Mark Sanchez stabbing case

A legal dispute tied to a violent late-night encounter involving Mark Sanchez has unexpectedly pulled one of Indianapolis’s most famous restaurants into the spotlight.

Huse Culinary, the parent company of the famed St. Elmo Steak House, has denied allegations that it bears any responsibility for Sanchez‘s fiery altercation with a 69-year-old truck driver, and that denial is now central to a larger dispute playing out in court.

The controversy stems from a violent October 4 incident in downtown Indianapolis that left Sanchez hospitalized with multiple stab wounds and facing a mix of criminal charges.

The incident, which unfolded after Sanchez was allegedly drinking in the city ahead of a Las Vegas Raiders–Indianapolis Colts game, has spawned both a criminal prosecution and a civil lawsuit from the alleged victim, Perry Tole.

According to legal filings made public this month, Tole added St. Elmo Steak House as a defendant in his lawsuit against Sanchez and Fox Corporation, where Sanchez worked as an NFL analyst.

Tole‘s complaint claims that Sanchez was “visibly intoxicated” after visiting the restaurant and that the establishment should be held partially liable for the events that followed.

In a sharp rebuttal filed Dec. 2, Huse Culinary denied those accusations, asserting that the world-renowned steakhouse did not over-serve Sanchez or contribute to the circumstances that led to the altercation.

The company’s legal team argues that it had no duty to prevent what occurred later and that the claims against it are without factual support.

Tole‘s addition of St. Elmo to the suit has injected fresh legal complexity into a case already attracting national attention.

St. Elmo’s response

Huse Culinary’s denial is not just a simple rebuttal. It’s a strategic positioning that comes as Fox Corporation seeks to shift the entire lawsuit from the Indiana state court to the federal court.

Lawyers for Fox argue that St. Elmo’s presence as a defendant was “fraudulently joined” solely to keep the case in local jurisdiction rather than allow removal to federal court.

In a Dec. 22 filing, Fox’s attorneys highlighted that both Sanchez and the corporation are out-of-state defendants.

Sanchez, a resident of California, and Fox, a Delaware corporation with principal operations in New York, are factors that could support federal jurisdiction absent Huse Culinary’s involvement.

Legal experts say the dispute over jurisdiction could significantly shape the trajectory of the civil case and any potential damages award.

If the court agrees with Fox that St. Elmo was improperly joined, the lawsuit could be heard in federal court, where procedural rules and jury pools differ from state tribunals.

Fox’s filing contends that the claim against St. Elmo lacks merit as a matter of law and that the eatery was dragged into the case to prevent a federal transfer.

The restaurant itself has staunchly denied any wrongdoing. In its response, Huse Culinary argues the allegations about serving alcohol to a “visibly intoxicated” person are false and that it had no knowledge of Sanchez‘s conduct later that night.
