Haley Kalil is intensifying her effort to dismiss a lawsuit filed by her ex-husband, former NFL offensive tackle Matt Kalil, over comments she made during a 2025 livestream that he claims were invasive and damaging.
According to legal documents obtained by TMZ, the Sports Illustrated Swimsuit model argues she never mentioned Matt by name during the now-viral appearance on Marlon Garcia‘s “Mar-Athon” Twitch livestream.
During that stream, she described the size of a former partner’s genitals in explicit terms and suggested it contributed to the breakdown of her marriage.
Matt Kalil, who played seven seasons in the NFL after being selected in the first round of the draft and retired following the 2018 season, filed suit in January.
He alleges that Haley’s “invasive commentary” undermined his efforts to maintain a low profile after his football career ended. The complaint claims that “viewers could and did readily infer” that he was the subject of her remarks.
In her motion to dismiss, Haley contends that because both she and her former husband are public figures, audience speculation does not equate to her explicitly identifying him. She also argues that her comments fall under protected speech.
Free speech defense at center of dispute
Haley’s legal team maintains that there is no precedent supporting Matt’s claims. In the new filings, she asserts that “there’s no case law where a woman’s truthful account of her own sexual pain has been found to be an invasion of someone else’s privacy.”
Her attorney, Matthew Bialick, told TMZ that the case raises constitutional concerns. “A woman’s right to provide a truthful account of her own relationships and her own past sexual trauma lies at the very core of First Amendment protections,” Bialick said in a statement. He added that Matt’s brief referenced the First Amendment only briefly and did not include substantive constitutional analysis.
Haley, 33, is a former Miss Minnesota USA and has appeared in the pages of Sports Illustrated Swimsuit. Matt, 36, spent the bulk of his career with the Minnesota Vikings before retiring from professional football.
A judge has not yet ruled on Haley’s motion to dismiss. Her legal team has said they are confident the case will be thrown out and that she will seek attorneys’ fees if the dismissal is granted.
